Terms of Service

1. Acceptance of Terms

• By accessing or using the HariOmm Enterprises website, client portal, or any of our technology services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).
• If you do not agree to these Terms, you may not access or use the Services. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Services

• HariOmm provides technology services for small businesses — including websites, online booking, customer portals, automation, and a platform for project management, approvals, billing, and social media publishing.
• We may modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice of material changes that affect your active engagement.

3. Accounts & Access

• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate and complete information when registering and to keep your business and contact details current.
• Unauthorized use of your account should be reported to us immediately. We are not liable for losses from unauthorized access you failed to report.

4. Client Responsibilities

• You are responsible for the accuracy and legality of all content, brand assets, and information you provide to us or publish through the platform.
• You agree to provide timely review of deliverables, approvals, and feedback needed to execute your engagement.
• You must comply with the terms and policies of any third-party social platform you connect, including Facebook, Instagram, LinkedIn, Google, and others.

5. Social Media Publishing

• When you connect a social account, you authorize HariOmm to publish approved content on your behalf through that platform’s official authorization process.
• HariOmm is not responsible for content rejection, account suspension, or reach limitations imposed by third-party platforms.
• You retain ownership of all content you create or upload. You grant HariOmm a limited license to use, display, and publish that content solely to deliver the Services.

6. Fees & Billing

• Subscription plans, setup fees, and add-ons are described on your proposal and the pricing page. Fees are billed in advance on the cadence selected at checkout.
• Payment is processed securely through Stripe. Your subscription remains active until you cancel or it is terminated under these Terms.
• Setup fees and completed consulting work are non-refundable except where required by law.

7. SMS Communications

• HariOmm may send SMS messages to phone numbers you provide, including transactional/service messages (proposal delivery, appointment reminders, account notifications) and, with your separate affirmative consent, marketing/promotional messages.
• Consent to receive marketing SMS is not a condition of purchasing any HariOmm service. You may opt out of marketing SMS at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any marketing message. Opting out of marketing SMS does not affect transactional/service messages.
• Message and data rates may apply. Message frequency varies. Reply HELP for assistance. To re-subscribe, you must provide affirmative consent through an explicit mechanism — ordinary inbound messages are not treated as consent.
• Marketing SMS consent is tracked independently from email consent. Opting out of one channel does not affect the other.

8. Cancellation & Termination

• You may cancel your subscription at any time from the client portal or by contacting us. Cancellation stops future billing and does not constitute a refund of fees already paid.
• We may suspend or terminate your access if you breach these Terms, fail to pay fees when due, or your account remains inactive for an extended period.
• Upon termination, your right to use the Services ends immediately. We will retain your data as described in our Privacy Policy to allow future reactivation unless you request deletion.

9. Intellectual Property

• All HariOmm software, branding, methodology, and platform content are owned by HariOmm Enterprises and protected by intellectual property laws.
• We grant you a non-exclusive, non-transferable license to use the platform solely for the duration of your active engagement.
• You may not copy, modify, distribute, reverse-engineer, or create derivative works from our platform without our written consent.

10. Confidentiality

• Each party agrees to keep confidential any non-public information shared during the engagement, including business strategy, customer data, and proprietary processes.
• This obligation survives termination of the Services and remains in effect for two (2) years thereafter.

11. Disclaimers

• The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee specific business outcomes, marketing results, search rankings, or engagement metrics from our consulting or publishing services.

12. Limitation of Liability

• To the maximum extent permitted by law, HariOmm’s aggregate liability for any claim arising from the Services is limited to the fees you paid us in the twelve (12) months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption.

13. Governing Law

• These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles.
• Any dispute will be resolved exclusively in the courts located in Washington, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

• We may update these Terms to reflect changes in our services or legal requirements. We will notify you of material changes through the platform or by email. The “last updated” date below always reflects the current version.
